Terms of Service
Effective October 31, 2026
1. Agreement
These Terms of Service ("Terms") are an agreement between you and Dialed ("Dialed," "we," "us," "our"), the operator of dialedreps.io and the Dialed practice app (together, the "Service"). By creating a session, starting a practice call, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use Dialed
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you confirm you're authorized to bind that business to these Terms, and "you" includes that business.
3. What Dialed is, and isn't
- Dialed is a practice and training tool. It lets you hold simulated sales conversations (by text or voice) with AI-generated prospects and receive automated feedback and scores.
- All prospects are fictional. Names, businesses, situations and details are generated for practice. Any resemblance to real people or businesses is coincidental.
- Scores, feedback, suggested lines and all other output are generated by artificial intelligence. They can be inaccurate, incomplete, inconsistent or inappropriate for your situation. They are educational opinions, not professional, legal, financial or business advice.
- No guarantee of results. We make no promise that using Dialed will improve your skills, increase bookings, sales, income, or commissions, or produce any particular outcome. Any examples, scores or statements on our site are illustrative only.
- Dialed does not place real calls to real people. You are solely responsible for how you conduct real-world sales activity, including compliance with telemarketing, do-not-call, consent, recording and consumer protection laws (such as the TCPA and state equivalents).
4. Accounts and access
You're responsible for activity that occurs under your access to the Service and for keeping any login details or access links confidential. Subscriptions are for one individual unless we agree in writing to a team plan. You may not share, resell or transfer access.
5. Subscriptions, automatic renewal and billing
- Automatic renewal. Paid plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly, as shown at checkout) and you authorize us and our payment processor, Stripe, to charge your payment method the then-current price plus any applicable taxes each period until you cancel.
- Founding member pricing. If you purchase at a founding member price, that price stays in place for as long as your subscription remains continuously active. If you cancel or your payment fails and your subscription ends, the founding price ends with it.
- Price changes. For non-founding plans, we may change prices with at least 30 days' notice by email. Changes take effect at your next renewal after the notice period. If you don't agree, you can cancel before the change takes effect.
- Usage limits. Plans may include limits (for example, voice minutes per month) as described on our pricing page or at checkout. Unused allowances don't roll over. Text practice is subject to fair use. We may limit or suspend use that is automated, abusive, or far beyond normal individual practice.
- Failed payments. If a payment fails, we may retry the charge and may suspend access until payment succeeds.
- Taxes. Prices exclude taxes unless stated. You're responsible for any applicable taxes.
- Payment processing. Payments are handled by Stripe. We don't store your full card number. Stripe's terms and privacy policy apply to your payment information.
6. Cancellation and refunds
You can cancel at any time, effective at the end of your current billing period. Details, including how to cancel and our refund policy, are in our Cancellation & Refund Policy, which is part of these Terms.
7. Free runs and trials
We may offer free practice runs or trials. We can change, limit or end free offerings at any time. Free use is provided "as is" with no obligation to continue.
8. Voice calls, recording and third-party processing
When you use voice practice, your voice is recorded and transcribed so the AI prospect can respond and so your call can be scored. By starting a voice call, you consent to this recording and transcription. Audio, transcripts and text you submit are processed by our service providers (currently including Retell AI for voice and Anthropic for AI responses and scoring) as described in our Privacy Policy. Don't share sensitive personal information (such as financial account numbers, health information or other people's private data) during practice.
9. Acceptable use
You agree not to:
- use the Service for anything unlawful, harassing, hateful, sexually explicit, or harmful, or to generate content that infringes others' rights;
- attempt to break, overload, scrape, reverse engineer, or bypass usage limits or security of the Service, or access it through automated means (bots, scripts) except as we permit;
- use the Service or its output to build a competing product, or to train AI models;
- misrepresent the Service's output as advice from a licensed professional;
- resell, sublicense or share access, or use another person's access.
We may suspend or terminate access, without refund, if we reasonably believe you've violated these Terms.
10. Intellectual property
The Service, including its software, design, prospect library, rubrics, prompts and branding, is owned by Dialed and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own training while you comply with these Terms. You keep ownership of what you type or say. You grant us a worldwide, royalty-free license to host, process and use your inputs and session data to operate, maintain, secure and improve the Service. If you send us feedback or suggestions, we may use them freely without obligation to you.
11. Disclaimers
The Service and all output are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements, that AI output will be accurate or appropriate, or that using the Service will produce any results. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law: (a) Dialed and its owner, contractors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, commissions, business opportunities, data or goodwill, arising out of or related to the Service or these Terms, even if advised of the possibility; and (b) our total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or $50. These limits apply to any theory of liability and even if a remedy fails of its essential purpose.
13. Indemnification
You agree to defend, indemnify and hold harmless Dialed and its owner, contractors and service providers from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the Service, your violation of these Terms, your real-world sales activity, or your violation of any law or third-party right.
14. Changes and termination
We may modify or discontinue features, prospects or the Service. We may update these Terms; if changes are material, we'll notify you by email or on the site before they take effect, and continued use after the effective date means you accept them. You can stop using the Service at any time. We may suspend or end your access for violation of these Terms or if we discontinue the Service; if we discontinue the Service for reasons other than your violation, we'll refund any prepaid fees for the unused portion of your current billing period. Sections that by their nature should survive (including 3, 10 through 13, and 15 through 16) survive termination.
15. Dispute resolution: binding arbitration and class action waiver
Talk to us first. Before filing any claim, you agree to email grantbulot@gmail.com with a description of the dispute and try in good faith to resolve it informally for at least 30 days.
Arbitration. If we can't resolve it, you and Dialed agree that any dispute, claim or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may be conducted by video or phone, or in the county where you live. Either party may instead bring an individual claim in small claims court if it qualifies.
Class action waiver: you and Dialed may bring claims against each other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief on a class or representative basis.
Opt-out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing grantbulot@gmail.com with your name and a clear statement that you opt out of arbitration.
If the class action waiver is found unenforceable for a particular claim, that claim must proceed in court and not in arbitration. Claims must be brought within one year after they arise, to the extent permitted by law.
16. General
These Terms are governed by the laws of the State of Kansas and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 15, exclusive venue for any court proceeding is the state or federal courts located in Kansas. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or transfer of the Service. These Terms, the Privacy Policy and the Cancellation & Refund Policy are the entire agreement between you and us about the Service.
